These Terms of Service (“Terms”) govern your access to and use of the website located at kascadian.com (the “Website”) and any services, content, or materials provided by Kascadian Enterprises Ltd. (“Kascadian”, “we”, “us”, or “our”) through the Website.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Website.

Note: Client projects and consulting engagements are governed primarily by a separate written service agreement between you and Kascadian. If there is any conflict between these Terms and a signed service agreement, the service agreement will prevail for that engagement.

1. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the Website in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorized access to any systems, accounts, or networks connected to the Website.
  • Interfere with or disrupt the operation of the Website or the servers or networks used to make the Website available.
  • Use any automated means (including bots, scrapers, or crawlers) to access, monitor, or copy any part of the Website without our prior written consent.

We reserve the right, in our sole discretion, to suspend or terminate your access to the Website for any reason, including violation of these Terms.

2. Consulting Services and Service Agreements

Kascadian provides consulting and implementation services (the “Services”), including but not limited to:

  • Ecommerce strategy and implementation
  • Amazon FBA and Seller Central consulting
  • Shopify, WordPress, and other ecommerce platform development and optimization
  • Automation, AI agent, and workflow consulting
  • Related technical and strategic advisory services

All paid Services are provided under a separate written service agreement (or statement of work) that sets out:

  • Scope of services
  • Fees and payment terms
  • Timelines and deliverables
  • Intellectual property and confidentiality
  • Other commercial terms

These Terms do not replace or supersede any signed service agreement. In the event of inconsistency, the service agreement controls with respect to the applicable engagement.

3. No Professional or Legal Advice

Content on the Website, including blog posts, case studies, guides, or other materials, is provided for general informational purposes only. It does not constitute:

  • Legal advice
  • Tax advice
  • Financial or investment advice
  • Professional advice specific to your business or situation

You are responsible for consulting with your own legal, tax, financial, or other professional advisors before acting on any information provided through the Website or in the course of Services.

4. Intellectual Property

From time to time, we may offer the ability to purchase Services, subscriptions, or other offerings through the Website or via third‑party payment providers such as Stripe.

  • You authorize us and/or our payment providers to charge your selected payment method for all amounts due, including applicable taxes.

We reserve the right to change pricing or discontinue offerings at any time, provided that any changes will not affect fees already agreed in a signed service agreement unless mutually agreed in writing.

To the fullest extent permitted by law, Kascadian disclaims all warranties, express or implied, including but not limited to:

These limitations do not limit or exclude any liability that cannot be limited or excluded under applicable law.

Liability limits with respect to paid Services will be governed by the applicable service agreement, which may provide different caps or limitations.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kascadian, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Website;
  • Your violation of these Terms; or
  • Your violation of any rights of a third party.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information.

By using the Website, you consent to our collection and use of information as described in the Privacy Policy.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada, without giving effect to any conflict of laws principles.

You agree that any disputes arising out of or relating to these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of British Columbia, and you hereby submit to the personal jurisdiction of those courts.
